These Terms & Conditions ("Terms") govern your access to and use of the Physicly mobile application and related services ("Physicly", "Service", "we", "us", or "our").

By creating an account or using Physicly, you agree to these Terms. If you do not agree with them, you should not use the Service.

1. The Service

Physicly is a fitness and wellness application that uses information provided by you, including body information, photos, health and fitness information, nutrition information, and activity information, to provide personalized insights, recommendations, and AI-powered features.

Features may change, be added, or be removed from time to time.

2. Eligibility

You must be at least 13 years old to use Physicly.

By using the Service, you represent that you meet this age requirement and that you are legally permitted to enter into these Terms.

3. Account

Some features require you to create an account.

You are responsible for:

• providing accurate information;
• maintaining the security of your account;
• keeping your authentication credentials secure; and
• all activity occurring through your account.

You should notify us if you believe your account has been accessed without authorization.

4. Health and Fitness Disclaimer

Physicly is a fitness and wellness tool and is not a medical service.

Information, analysis, recommendations, AI-generated content, workout suggestions, nutrition suggestions, body analysis, and other content provided by Physicly are for general informational and wellness purposes only.

Physicly does not provide medical diagnosis, treatment, or prevention of disease.

You should not rely on Physicly as a substitute for professional medical advice, diagnosis, or treatment.

Before making significant changes to your exercise, nutrition, or lifestyle, particularly if you have a medical condition, injury, or other health concern, consult an appropriately qualified healthcare professional.

If you experience a medical emergency, contact appropriate emergency services rather than using Physicly.

5. AI-Generated Content

Physicly uses artificial intelligence to provide certain features.

AI-generated results may be incomplete, inaccurate, outdated, or inappropriate for your particular circumstances.

You understand that AI-generated recommendations are not guaranteed to be accurate and should be evaluated using your own judgment.

Physicly does not guarantee that AI-generated content will produce any particular fitness, body composition, health, or other result.

6. User Content

You may submit content to Physicly, including photos, profile information, health and fitness information, nutrition information, workout information, and other content ("User Content").

You retain ownership of your User Content.

You grant Physicly the limited rights necessary to host, process, transmit, analyze, and otherwise use your User Content solely to provide and operate the Service and its features, subject to our Privacy Policy.

You represent that you have the necessary rights and permissions to submit User Content to Physicly.

7. Prohibited Use

You agree not to:

• use Physicly for unlawful purposes;
• attempt to gain unauthorized access to the Service or its systems;
• interfere with or disrupt the Service;
• reverse engineer or attempt to extract source code except where permitted by applicable law;
• abuse, exploit, or circumvent limitations of the Service;
• upload content that infringes another person's rights;
• use the Service to harm, harass, or impersonate another person; or
• use automated methods to access the Service in a manner that could interfere with its operation.

8. Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

We may also change features, functionality, limits, or other aspects of the Service without prior notice where reasonably necessary.

9. Subscriptions and Payments

Certain features of Physicly may require a paid subscription or other payment.

Subscription prices, billing periods, trials, available plans, and included features may change from time to time. The applicable price and terms presented to you at the time of purchase will apply to that purchase.

Purchases made through Apple's App Store are processed by Apple and are subject to Apple's applicable terms and conditions.

Subscription management, renewal, cancellation, and refunds for purchases made through the App Store are generally handled through Apple's systems and policies.

10. Intellectual Property

Physicly and its underlying software, design, branding, content, features, and technology are owned by or licensed to Physicly and are protected by applicable intellectual property laws.

Except for the rights expressly granted in these Terms, no rights are granted to you.

You may use the Service only for its intended personal purposes and in accordance with these Terms.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Physicly is provided on an "as is" and "as available" basis.

We make no warranties, express or implied, regarding:

• the accuracy or reliability of the Service;
• the accuracy of AI-generated information;
• the availability or uninterrupted operation of the Service;
• the suitability of the Service for your particular goals; or
• any particular fitness, health, nutritional, body composition, or other result.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Ivan Hubar and Physicly will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

13. Account Termination

You may stop using Physicly at any time and may request deletion of your account.

We may suspend or terminate access to the Service if you violate these Terms, abuse the Service, create security risks, or where otherwise reasonably necessary to protect the Service, users, or our rights.

Upon termination, provisions that by their nature should survive termination will remain in effect.

14. Privacy

Your use of Physicly is also governed by our Privacy Policy, which explains how we collect, use, store, and disclose information.

15. Third-Party Services

Physicly may rely on third-party services to provide certain functionality.

Your use of third-party services may also be subject to the terms and policies of those providers.

16. Changes to These Terms

We may update these Terms from time to time.

We will update the "Last updated" date when changes are made. Where appropriate, significant changes may be communicated through the Service.

Your continued use of Physicly after updated Terms become effective constitutes acceptance of the updated Terms.

17. Governing Law

These Terms will be governed by applicable law, without regard to conflict-of-law principles, except where mandatory law in your place of residence provides otherwise.

Nothing in these Terms is intended to deprive you of mandatory consumer or statutory rights that cannot legally be waived.
